*This iconic and adorable bus was not permitted in the parade due a conflict over the Town of Magnolia Springs Liability Waiver instituted when the Town took over the parade from the Magnolia Springs Community Association.   The waiver states the following"

3. With a full understanding of the foregoing, I voluntarily desire to participate in the Parade and assume all risks and waive and release and covenant not to sue the Town and its elected officials, volunteers, officers, employees and agents from any claims or liability for personal injury (including death) or property damage arising from or connected with participation in the Parade, even if the liability may arise out of negligence or carelessness of the Town or its elected officials, volunteers, officers, employees and agents. 

4. I further agree to hold harmless, indemnify and defend the Town and its elected officials, volunteers, officers, employees and agents, who through negligence or carelessness might otherwise be liable to me (or my heirs or assigns). In the event of injury or illness, I consent to and agree to be responsible for costs for transportation to a medical facility and whatever examination, procedure or treatment considered necessary by the medical personnel. This assumption of risk, release and hold harmless is binding on my heirs, dependents, executors, administrators, and assigns. 

No reasonable person would sign this.  Paragraph #3 asks every participant to assume ALL libility associated with the parade.  That is, say someone 10 entrants ahead runs over a child, every entrant would assume liability for this.   How about a terrorist event?  Shooting?  Accident with a horse?  Person struck by a piece of candy?   Furthermore entrants are liable for Town negligence - failure to provide security, lack of crowd control, lack of traffic control, food poisoning, drowning, etc.

Paragraph #4 allows the Town to further avoid responsiblity and passes it on to the entrants and their heirs or assigns.  Entrants also agree to defend the Town - even if the Town is negligent.   

These are not reasonable requests and this Waiver is likely created or approved by the Town Crier - Stone, Crosby, P.C.  The Parade will suffer from this action and it does nothing to build trust with the community, the residents who contribute thier time and money to this great event.  Every decision by a government can be undone by the next.  Magnolia Springs needs some common sense government.  You can have entrants assume some liability for their actions and the actions of persons riding with them, but not the actions of the crowd.  That falls upon the Town
